The four legislative sessions included 172 different topics<sub><sup>1<\/sup><\/sub>. Urgent and repeated proposed laws represented 86% of the proposals on the Parliament&#8217;s agenda, i.e. the proposals that directly reach the General Assembly, without being studied by the Parliamentary Committees. Moreover, 83% of law proposals were submitted by an individual Member of Parliament (MP) or by only one bloc, knowing that 23% of them were presented by individual and independent MPs not affiliated with any parliamentary bloc. On the other hand, only 8.4% were submitted by two blocs<sup>2<\/sup>, and only 5% were proposed by three or more parliamentary blocs<sup>3<\/sup>.<br \/><br \/>These figures indicate two things: First, despite the major crises affecting Lebanon, and the pressing need for a visionary and effective legislative initiative to navigate them, the majority of proposals have been in the form of &#8220;urgent legislation&#8221; and perhaps populism. Second, we have noticed that the majority of the proposals did not involve any discussion or cooperation between the blocs, while half of the proposals have not even been discussed within the parliamentary bloc itself, adding to indicators that they are not seriously addressing Lebanon\u2019s woes.<br \/><br \/>In the last three legislative sessions[4], the Parliament&#8217;s average productivity did not exceed 40% of the agenda set for each session. The Parliament examined only 30% of the proposals in <a href=\"https:\/\/legal-agenda.com\/\u0643\u0627\u0645\u0644-\u0646\u062a\u0627\u0626\u062c-\u0627\u0644\u062c\u0644\u0633\u0629-\u0627\u0644\u062a\u0634\u0631\u064a\u0639\u064a\u0629-\u0623\u064a\u0627\u0631-2020-\u0645\u062d\u0627\/\">May&#8217;s session<\/a>, 32.5% in <a href=\"https:\/\/legal-agenda.com\/\u0643\u0627\u0645\u0644-\u0646\u062a\u0627\u0626\u062c-\u0627\u0644\u062c\u0644\u0633\u0629-\u0627\u0644\u062a\u0634\u0631\u064a\u0639\u064a\u0629-30-\u0623\u064a\u0644\u0648\u0644-2020-\u0627\/?fbclid=IwAR2iYmfExbjOSbUBFCQRqGUiKby-fUwiaiQcEh8NAUSzY4bNhEZdDqu_z8E\">September\u2019s session<\/a><sup>5<\/sup>, and 57% of them in <a href=\"https:\/\/legal-agenda.com\/\u0643\u0627\u0645\u0644-\u0646\u062a\u0627\u0626\u062c-\u0627\u0644\u062c\u0644\u0633\u0629-\u0627\u0644\u062a\u0634\u0631\u064a\u0639\u064a\u0629-21-\u0643\u0627\u0646\u0648\u0646-\u0627\u0644\u0623\/\">December&#8217;s session<\/a><sup>6<\/sup>. In the last session, it adopted a deceptive strategy by including &#8220;reform&#8221; proposals in the agenda, but it turned out that there was prior <a href=\"https:\/\/legal-agenda.com\/\u062f\u0631\u0648\u0633-\u0636\u062f\u0651-\u0627\u0644\u062f\u064a\u0645\u0642\u0631\u0627\u0637\u064a\u0651\u0629-\u0641\u064a-\u0645\u062c\u0644\u0633-\u0627\u0644\u0646\u0648\u0651\u0627\u0628\/\">preparation<\/a> to adjourn the session before completing discussion of the entire schedule.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"eclipsing-vital-laws-and-watering-down-reforms\"><strong>Eclipsing Vital Laws and Watering Down Reforms<\/strong><\/h4>\n\n<p class=\"wp-block-paragraph\">The outcome of these sessions was as follows:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The ratification by the Parliament of 60 laws<sup>7<\/sup>, most notably lifting <a href=\"https:\/\/legal-agenda.com\/\u0645\u0627\u0630\u0627-\u0633\u064a\u0646\u0627\u0642\u0634-\u0627\u0644\u0628\u0631\u0644\u0645\u0627\u0646-\u0627\u0644\u0644\u0628\u0646\u0627\u0646\u064a-\u0641\u064a-21-\u0643\u0627\u0646\u0648\/\">banking secrecy<\/a> for public officials (but rendering it toothless after altering its content)<\/li>\n<li>The <a href=\"https:\/\/legal-agenda.com\/\u0627\u0642\u062a\u0631\u0627\u062d-\u0642\u0627\u0646\u0648\u0646-\u0627\u0644\u0634\u0641\u0627\u0641\u064a\u0629-\u0648\u0627\u0644\u0643\u0641\u0627\u0621\u0629-\u0641\u064a-\u062a\u0639\u064a\/\">mechanism for appointments<\/a> of top-level civil servants (first category), a law that was repealed by the Constitutional Council after an appeal was filed before it<sup>8<\/sup>.<\/li>\n<li>The amendment of the <a href=\"https:\/\/legal-agenda.com\/\u0645\u0627\u0630\u0627-\u0633\u064a\u0646\u0627\u0642\u0634-\u0627\u0644\u0628\u0631\u0644\u0645\u0627\u0646-\u063a\u062f\u0627\u061f-\u0628\u0639\u062f-\u0642\u0631\u0627\u0628\u0629-\u0627\u0644\/\">illicit enrichment law<\/a>.<\/li>\n<li>The amendment of <a href=\"https:\/\/legal-agenda.com\/\u0645\u0627\u0630\u0627-\u0633\u064a\u0646\u0627\u0642\u0634-\u0627\u0644\u0628\u0631\u0644\u0645\u0627\u0646-\u063a\u062f\u0627\u061f-\u0627\u0644\u0645\u0627\u062f\u0629-47-\u062a\u0643\u0631\/\">Article 47 of the Criminal Procedure Code<\/a>, which guaranteed suspects the right to access a lawyer during preliminary investigations.<\/li>\n<li>The <a href=\"https:\/\/legal-agenda.com\/\u0645\u0644\u0627\u062d\u0638\u0627\u062a-\u062d\u0648\u0644-\u0642\u0627\u0646\u0648\u0646-\u062d\u0645\u0627\u064a\u0629-\u0627\u0644\u0645\u0646\u0627\u0637\u0642-\u0627\u0644\u0645\u062a\u0636\/\">law to protect areas<\/a> affected by the August 4th blast and support their reconstruction.<\/li>\n<li>The <a href=\"https:\/\/legal-agenda.com\/\u0627\u0644\u0645\u062c\u0644\u0633-\u0627\u0644\u0646\u064a\u0627\u0628\u064a-\u064a\u0642\u0631\u0651-\u062d\u0642-\u0634\u0647\u062f\u0627\u0621-\u0627\u0644\u0645\u0631\u0641\u0623-\u0628\u0627\/\">law equating \u2018martyrs\u2019 of the port explosion<\/a> with the Lebanese army martyrs.<\/li>\n<li>The <a href=\"https:\/\/legal-agenda.com\/\u0645\u0627\u0630\u0627-\u0633\u064a\u0646\u0627\u0642\u0634-\u0627\u0644\u0628\u0631\u0644\u0645\u0627\u0646-\u0627\u0644\u0644\u0628\u0646\u0627\u0646\u064a-\u0641\u064a-21-\u0643\u0627\u0646\u0648\/\">banking secrecy law<\/a> amendment for forensic audit purposes.<\/li>\n<li>The protection from <a href=\"https:\/\/legal-agenda.com\/\u062a\u0639\u062f\u064a\u0644-\u0642\u0627\u0646\u0648\u0646-\u062d\u0645\u0627\u064a\u0629-\u0627\u0644\u0646\u0633\u0627\u0621-\u0648\u0623\u0641\u0631\u0627\u062f-\u0627\u0644\u0623\u0633\u0631\/\">domestic violence law<\/a> amendment.<\/li>\n<li>The <a href=\"https:\/\/legal-agenda.com\/\u0625\u062b\u0646\u062a\u0627-\u0639\u0634\u0631\u0629-\u0645\u0644\u0627\u062d\u0638\u0629-\u0639\u0644\u0649-\u0645\u0642\u062a\u0631\u062d-\u062a\u062c\u0631\u064a\u0645-\u0627\u0644\u062a\u0651\/\">law<\/a> criminalizing sexual harassment.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">However, it was evident that the legislators lacked any vision to cope with crises of unprecedented gravity. Similarly, throughout the period following October 17th 2019, they failed to pass any vital laws. This includes the capital control law, the social safety net laws and the substantial reform laws including the independence of the judiciary law and making the parliamentary committee deliberations public.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"stealthy-legislation\"><strong>&#8220;Stealthy&#8221; Legislation<\/strong><\/h4>\n\n<p class=\"wp-block-paragraph\">Ordinary sessions were turned into legislative sessions or ended up consisting of proposal discussions that were not listed on the agenda, in violation of the Parliament&#8217;s internal regulations. Said regulations require disclosing and communicating the agenda to MPs with a copy of the bills, proposed laws and reports that will be tackled, at least 24 hours before the session<sup>9<\/sup>. This can be described as <a href=\"https:\/\/legal-agenda.com\/\u0627\u0644\u062a\u0634\u0631\u064a\u0639-\u062e\u0644\u0633\u0629-\u0623\u0648-\u0625\u062e\u0631\u0627\u062c-\u062c\u0644\u0633\u0627\u062a-\u062a\u0634\u0631\u064a\u0639\u064a\u0629-\u0645\u0646\/\">&#8220;stealthy&#8221; legislation<\/a> or legislation by surprise.<br \/><br \/>These practices prevent citizens, as well as parliamentarians, from discussing any of these bills or proposals. For example, during <a href=\"https:\/\/legal-agenda.com\/\u062c\u0644\u0633\u0629-\u062a\u0634\u0631\u064a\u0639\u064a\u0629-\u0645\u0641\u0627\u062c\u0626\u0629-\u062a\u0634\u0631\u064a\u0639-\u0627\u0644\u0645\u0641\u0627\u062c\u0623\u0629-\u0625\u0633\/\">a session<\/a> to discuss the state of the <a href=\"https:\/\/legal-agenda.com\/\u0633\u0639\u062f-\u064a\u0637\u0627\u0644\u0628-\u0628\u062a\u0639\u0628\u0626\u0629-\u0639\u0627\u0645\u0629-\u0644\u0625\u0633\u0639\u0627\u0641-\u0627\u0644\u0646\u0627\u0633-\u0648\u0644\u064a\/\">emergency declaration decree<\/a><sup>10<\/sup>, multiple MPs demanded to open a legislative session as soon as the decree was ratified. As a result, 3 proposed laws, submitted in the form of repeated and urgent proposals, were unexpectedly approved. One of the most dangerous unscheduled proposals that had been discussed and approved despite being off the agenda was the <a href=\"https:\/\/legal-agenda.com\/\u0645\u0644\u0627\u062d\u0638\u0627\u062a-\u062d\u0648\u0644-\u0642\u0627\u0646\u0648\u0646-\u062d\u0645\u0627\u064a\u0629-\u0627\u0644\u0645\u0646\u0627\u0637\u0642-\u0627\u0644\u0645\u062a\u0636\/\">law to protect areas affected<\/a> by the port explosion and support their reconstruction. This had significant consequences for the damaged areas and rights of affected people.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"mps-rhetoric-acquitting-corrupt-officials-and-urging-authorities-to-stand-strong\"><strong>MPs\u2019 Rhetoric: Acquitting Corrupt Officials and Urging Authorities To Stand Strong<\/strong><\/h4>\n\n<p class=\"wp-block-paragraph\">Interventions during the sessions by Members of Parliament were marked by comments filled with supremacy and misogynist rhetoric. They represented the most striking evidence of a complete absence of any sense of responsibility. For starters, MPs did not hesitate to deliver <a href=\"https:\/\/legal-agenda.com\/\u062f\u0631\u0648\u0633-\u0636\u062f\u0651-\u0627\u0644\u062f\u064a\u0645\u0642\u0631\u0627\u0637\u064a\u0651\u0629-\u0641\u064a-\u0645\u062c\u0644\u0633-\u0627\u0644\u0646\u0648\u0651\u0627\u0628\/\">accountability speeches<\/a>, acquitting themselves of corruption<sup>11<\/sup>. MP Elie Al Ferzli did not hesitate to ask for <a href=\"https:\/\/legal-agenda.com\/\u0627\u0644\u0645\u062c\u0644\u0633-\u0627\u0644\u0646\u064a\u0627\u0628\u064a\u0651-\u064a\u0637\u0644\u0642-\u0627\u0644\u0645\u062d\u0627\u0633\u0628\u0629-\u062a\u0645\u062c\u064a\u062f\u0627\/\">immunities to be waived<\/a>, because he knows that all political figures are surrounded by &#8220;purity and sanctity&#8221;. When MP Bilal Abdullah accused the Central Bank&#8217;s governor of &#8220;evading his responsibilities&#8221;, Nabih Berri got angry and asked for the phrase to be deleted from the minutes. He insisted on deleting it despite it being amended twice by Abdullah, and addressed MP Hadi Abu Al-Hosn, who belongs to the same parliamentary bloc, asking him: &#8220;What is wrong with him today?\u201d, referring to Abdullah.<br \/><br \/>Al Ferzli also deliberately delivered, in most of the sessions, speeches that restore <a href=\"https:\/\/legal-agenda.com\/\u062c\u0644\u0633\u0629-\u062a\u0634\u0631\u064a\u0639\u064a\u0629-\u0644\u0627\u0633\u062a\u0639\u0627\u062f\u0629-\u0647\u064a\u0628\u0629-\u0627\u0644\u0645\u062c\u0644\u0633-\u0641\u064a-\u0645\/\">confidence in authorities<\/a>. He called upon them to unite, close ranks, and withstand threats from any external [opponent], on the street and in the media (and implicitly in the judiciary). He hates that authorities attempt to submit to people\u2019s wishes, even to gain certain interests. He rejected a law proposal showing &#8220;a tendency for a populist situation designed to tell people that we are innocent of this righteous blood\u201d. Then, he shouted at MPs, \u201cSirs, populism is doomed to extinction&#8230;beware of submitting to the banking secrecy trick, because I see in your faces full trust, complete innocence, and clean hands\u201d.<br \/><br \/>We also witnessed bullying incidents by MPs against caretaker ministers, as Al Ferzli rebuked them for tweeting that \u201cthey were \u2018here\u2019 because of the revolution or the people\u201d, stressing that their confidence is not from the revolution, but from parliamentarians. He threatened them, if they were to repeat such tweets, saying: \u201cI swear to God, I will call for a no-confidence vote against you\u201d.<br \/><br \/>The Lebanese legislature utterly failed at addressing the numerous challenges caused by the economic collapse, the pandemic and the Port Massacre. If it succeeded at anything, it is undoubtedly buying time for a crumbling house of cards and reinforcing the status quo.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\" style=\"font-size: 12px;\"><sup>1<\/sup> Just to clarify, the total items on the agenda of the four sessions is 195, but the October 30-31st 2020 session agenda included 16 proposals that had been initially placed on the agenda of the May 28th 2020 session. Another proposal was carried forward from the agenda of April\u2019s session to the October 30-31st 2020 session. Finally, 4 proposals were transferred from the April 21-22nd session&#8217;s agenda to the <a href=\"https:\/\/legal-agenda.com\/%D9%83%D8%A7%D9%85%D9%84-%D9%86%D8%AA%D8%A7%D8%A6%D8%AC-%D8%A7%D9%84%D8%AC%D9%84%D8%B3%D8%A9-%D8%A7%D9%84%D8%AA%D8%B4%D8%B1%D9%8A%D8%B9%D9%8A%D8%A9-%D8%A3%D9%8A%D8%A7%D8%B1-2020-%D9%85%D8%AD%D8%A7\/\" target=\"_blank\" rel=\"noreferrer noopener\">May 28th<\/a> agenda, while 29 proposals were transferred from the <a href=\"https:\/\/legal-agenda.com\/%D9%85%D8%A7%D8%B0%D8%A7-%D8%B3%D9%8A%D9%86%D8%A7%D9%82%D8%B4-%D8%A7%D9%84%D8%A8%D8%B1%D9%84%D9%85%D8%A7%D9%86%D9%8A-%D8%A7%D9%84%D9%84%D8%A8%D9%86%D8%A7%D9%86%D9%8A-%D8%A7%D9%84%D9%8A%D9%88%D9%85\/\" target=\"_blank\" rel=\"noreferrer noopener\">September 30th 2020<\/a> agenda to the <a href=\"https:\/\/legal-agenda.com\/%D9%85%D8%A7%D8%B0%D8%A7-%D8%B3%D9%8A%D9%86%D8%A7%D9%82%D8%B4-%D8%A7%D9%84%D8%A8%D8%B1%D9%84%D9%85%D8%A7%D9%86-%D8%A7%D9%84%D9%84%D8%A8%D9%86%D8%A7%D9%86%D9%8A-%D8%BA%D8%AF%D8%A7%D9%8B%D8%9F-%D8%AF\/\" target=\"_blank\" rel=\"noreferrer noopener\">December 21st 2020<\/a> session&#8217;s agenda.<br \/><br \/><sup>2<\/sup> Most notably, the proposal to waive ministerial immunity; the proposal to amend Article 96 of the 2019 Budget Law, which provides for the payment deadline extension of taxi registration plate installments; the proposal to abolish the Ministry of the Displaced and the Central Fund for the Displaced; the Anti-Food Waste proposal; and the proposal to set exceptional and temporary controls on bank transfers.<br \/><br \/><sup>3<\/sup> In particular, the deadline extension proposal to regularize building violations; the proposal to regulate the cultivation of cannabis for medical use; and the proposal to not include sentences issued under the Publications Law in the criminal record.<br \/><br \/><sup>4<\/sup> It should be noted that in the legislative session held in <a href=\"https:\/\/legal-agenda.com\/%D9%83%D8%A7%D9%85%D9%84-%D9%86%D8%AA%D8%A7%D8%A6%D8%AC-%D8%A7%D9%84%D8%AC%D9%84%D8%B3%D8%A9-%D8%A7%D9%84%D8%AA%D8%B4%D8%B1%D9%8A%D8%B9%D9%8A%D8%A9-%D9%86%D9%8A%D8%B3%D8%A7%D9%86-2020-1-%D8%AC\/\" target=\"_blank\" rel=\"noreferrer noopener\">April 2020<\/a>, the Parliament discussed its entire agenda (71 items, including 5 that were tackled from outside the agenda).<br \/><br \/><sup>5<\/sup> Proposals from outside the agenda.<br \/><br \/><sup>6<\/sup> Proposals from outside the agenda.<br \/><br \/><sup>7<\/sup> <a href=\"https:\/\/legal-agenda.com\/%D9%83%D8%A7%D9%85%D9%84-%D9%86%D8%AA%D8%A7%D8%A6%D8%AC-%D8%A7%D9%84%D8%AC%D9%84%D8%B3%D8%A9-%D8%A7%D9%84%D8%AA%D8%B4%D8%B1%D9%8A%D8%B9%D9%8A%D8%A9-%D8%A3%D9%8A%D8%A7%D8%B1-2020-%D9%85%D8%AD%D8%A7\/\" target=\"_blank\" rel=\"noreferrer noopener\">Full outcome of the April 2020 legislative session also known as the &#8220;Decision is Mine\u201d or \u201cHow to Tighten Grip on Society\u201d session; Ratification of 24 laws out of 70 proposals.
